Welcome to Carpentersville Tree Service, a licensed and insured tree care company located at 62 S Kennedy Dr Suite B, Carpentersville, IL 60110. These Terms and Conditions ("Terms") govern your use of our tree services, including tree removal, trimming, pruning, stump grinding, emergency storm response, and related work. By requesting a quote, scheduling service, or engaging our team, you agree to be bound by these Terms.
1. Service Agreement
- Quotes and Estimates: All quotes are valid for 30 days from the date issued unless otherwise stated. Estimates are based on visual inspection and may be adjusted upon closer examination of site conditions (e.g., underground utilities, tree health, access restrictions).
- Acceptance: Service is confirmed only upon receipt of a signed estimate, verbal approval, or payment of a deposit (if required).
- Scope of Work: We perform only the services outlined in the written or confirmed estimate. Additional work requires a new agreement.
2. Pricing and Payment
- Pricing: Rates are based on time, equipment, crew size, disposal fees, and job complexity. All prices include labor, equipment, and standard debris removal unless noted.
- Payment Terms:
- Full payment is due upon completion of service unless a prior arrangement is made.
- We accept cash, check, credit/debit cards, and approved digital payments.
- A $50 fee applies to returned checks.
- Deposits (up to 50%) may be required for large jobs or material purchases.
- Late Payments: Overdue balances accrue 1.5% monthly interest after 30 days. We reserve the right to place a lien on the property for unpaid services.
3. Scheduling and Access
- Scheduling: Appointments are scheduled on a first-come, first-served basis. We make every effort to arrive within the agreed time window but are not liable for delays due to weather, traffic, or equipment issues.
- Site Access: You must provide clear, safe access to the work area. This includes moving vehicles, pets, and obstacles. Additional charges apply if access is restricted.
- Underground Utilities: You are responsible for marking private underground lines (e.g., sprinklers, dog fences). We call 811 (JULIE) for public utilities before digging.
4. Safety and Property Protection
- Safety First: Our crew follows ANSI Z133 safety standards and uses proper personal protective equipment (PPE).
- Property Care: We take reasonable precautions to protect lawns, driveways, and structures. However, minor lawn rutting, branch drag marks, or sawdust are normal and not considered damage.
- Pre-Existing Conditions: We are not responsible for damage to unseen or undisclosed structures (e.g., septic systems, invisible fences, shallow utilities).
5. Tree and Stump Removal
- Ownership: You must confirm ownership of the tree(s) or have legal authority to authorize removal. We are not liable for disputes with neighbors or HOAs.
- Stump Grinding: Standard grinding depth is 6–8 inches below grade. Deeper grinding or full root removal is available at additional cost.
- Wood and Debris:
- All brush, branches, and logs are removed unless you request to keep firewood (must be specified in advance).
- Wood chips can be left on-site or hauled away (default is removal unless requested).
6. Cancellations and Changes
- Cancellations: Free if made 24 hours before scheduled service. Same-day cancellations or no-shows may incur a $150 trip charge.
- Weather Delays: We reserve the right to reschedule due to unsafe conditions (high winds, lightning, heavy rain, snow, or ice). No penalty applies.
7. Warranty and Limitations
- Workmanship Warranty: We guarantee our work for 30 days from completion. Issues due to improper execution will be corrected at no cost.
- No Tree Health Guarantee: We do not guarantee tree survival after pruning, cabling, or transplanting. Tree health depends on species, condition, and post-care.
- Acts of Nature: We are not liable for tree failure due to storms, disease, or root issues after service.
8. Liability and Insurance
- Insurance: We carry general liability and workers’ compensation insurance. Certificates are available upon request.
- Your Responsibility: You must disclose known hazards (e.g., bee hives, unstable trees, power lines). Failure to disclose may void liability coverage.
- Damage Claims: Report any concerns within 48 hours of service completion. Claims after this period may not be honored.
9. Emergency Services
- Emergency calls are prioritized and may incur after-hours or hazard premiums.
- We are not liable for delays during widespread storm events when demand exceeds capacity.
10. Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State of Illinois.
- Disputes: Any disputes will first attempt resolution through good-faith negotiation. If unresolved, disputes will be settled in Kane County, IL courts.
11. Changes to Terms
We may update these Terms at any time. The latest version will be posted on our website. Continued use of our services after changes constitutes acceptance.
